Important things related to the proposed new law on three divorces
- This draft has been prepared by an inter-ministerial group chaired by Home Minister Rajnath Singh. Other members included Foreign Minister Sushma Swaraj, Finance Minister Arun Jaitley, Law Minister Ravi Shankar Prasad and Minister of State for Home Affairs PP Chaudhary.
- The proposed law will be applicable to three divorces or 'divorce a biddat' at one time and it will give the victim the power to ask the magistrate for seeking alimony for herself and minor children.
- Under this, the victim may also request a magistrate to protect the minor children and the magistrate will make a final decision on this issue.
- Under the draft law, any kind of divorce (by speaking, writing or electronic, electronic, like email, SMS and WhatsApp) will be illegal.
- According to the draft law, three divorces will be illegal and void at one time and the husband who does so can be sentenced to three years imprisonment. It will be a non-bailable and cognizable offense.
- The proposed law is to be implemented all over the country except Jammu and Kashmir.
- The subject of divorce and marriage comes in the concurrent list of the constitution and the government is capable of making laws on it in an emergency, but keeping in view the recommendations of the Sarkaria Commission, the government decided to consult the states.
- The official said that it was planned to bring it to the winter session of Parliament.
- The winter session of Parliament will commence from December 15 and run till 5 January.
- In the past, Home Minister Rajnath Singh had said that it is the strong wish of the people of India that the three divorces and the National Backward Classes Commission make laws on both these issues and the government is committed to fulfill this wish.
